AVIRA DENTAL

GENERAL TERMS AND CONDITIONS

1. Acceptance of these Terms

These General Terms and Conditions govern the provision of dental services by Avira Dental (“the Practice”).

By booking an appointment, attending the Practice, receiving treatment, or otherwise engaging our services, you acknowledge that you have read, understood and agree to these Terms and Conditions, together with our Privacy Policy and any applicable Treatment Consent Forms.

Where a Treatment Consent Form has been signed for a particular procedure, that consent forms part of the agreement between you and the Practice.

The Practice may amend these Terms and Conditions from time to time. The current version will be made available upon request and, where applicable, published on our website.

2. Appointments

Appointments are reserved exclusively for you.

Patients are requested to arrive on time and complete any required documentation before treatment commences.

If you arrive late, the Practice will make reasonable efforts to accommodate you. However, where insufficient clinical time remains to safely complete treatment, your appointment may need to be shortened or rescheduled.

The Practice reserves the right to reschedule appointments due to unforeseen circumstances including clinician illness, emergencies, equipment failure or other circumstances beyond our reasonable control.

Emergency patients may occasionally require priority treatment, which may result in delays to scheduled appointments.

3. Cancellations and Missed Appointments

We respectfully request a minimum of 48 hours’ notice if you need to cancel or reschedule an appointment.

Appointments cancelled without the required notice, or appointments not attended, may incur a cancellation fee.

Where a deposit has been paid, all or part of the deposit may be retained in accordance with these Terms.

Repeated late cancellations or failures to attend may result in:

  • future appointments requiring deposits or full prepayment;
  • refusal of future bookings; or
  • discontinuation of ongoing treatment where appropriate.

4. Deposits

The Practice may require deposits for certain appointments or treatment, including lengthy appointments, laboratory-based treatment, orthodontics, implant treatment, cosmetic dentistry or other complex procedures.

Deposits secure both clinical appointment time and, where applicable, planning, laboratory work and manufacture of customised dental appliances or restorations.

Deposits will generally be credited towards the total treatment fee.

Once laboratory work, digital treatment planning or manufacture of customised appliances or restorations has commenced, the associated costs become payable and may not be refundable, even if treatment is cancelled, postponed or discontinued.

5. Treatment Plans and Quotations

Treatment plans and fee estimates are based upon clinical findings available at the time of examination.

Clinical circumstances may change during treatment, and additional procedures or modifications to the treatment plan may become necessary.

Any quotation provided is an estimate only and does not constitute a fixed-price contract unless expressly stated otherwise.

Where significant changes become necessary, the Practice will discuss these with you before proceeding whenever reasonably practicable.

6. Fees and Payment

Unless otherwise agreed in writing, payment is due on the day treatment is provided.

The Practice accepts payment using approved payment methods offered by the Practice.

Where third-party finance providers are used, their terms and conditions apply separately.

Failure to obtain finance approval does not remove your responsibility to pay the Practice for services provided.

7. Private Health Insurance and Government Schemes

The Practice will use reasonable efforts to estimate available benefits under private health insurance or government programs.

However, rebates are determined solely by the relevant insurer or government authority.

You remain responsible for payment of all treatment fees not covered by your insurer or government scheme.

8. Patient Responsibilities

Patients are responsible for:

  • providing complete and accurate medical and dental histories;
  • informing the Practice of changes to their health, medications or contact details;
  • following post-operative and home care instructions;
  • attending review appointments where recommended;
  • maintaining appropriate oral hygiene; and
  • asking questions where clarification is required.

Failure to follow professional advice may compromise treatment outcomes and may require additional treatment.

9. Treatment Consent

Clinical risks, expected benefits, treatment limitations, available alternatives and patient responsibilities are explained in the applicable Treatment Consent Form.

Patients acknowledge that they have had the opportunity to ask questions before providing consent.

Where treatment-specific consent is required, treatment will not proceed until appropriate consent has been obtained.

 10. Customised Appliances and Laboratory Work

Many dental treatments involve customised appliances, prostheses, restorations or other devices manufactured specifically for an individual patient by independent dental laboratories or manufacturers.

These items are individually manufactured and cannot ordinarily be reused, transferred or resold.

Once manufacture has commenced, associated laboratory and production costs become payable and are generally non-refundable.

Where a patient requests alterations for personal preference rather than clinical necessity, additional fees may apply.

11. Interrupted or Discontinued Treatment

If treatment is interrupted or discontinued by the patient, the Practice is entitled to recover the value of:

  • consultations already provided;
  • clinical treatment completed;
  • diagnostic records;
  • treatment planning;
  • laboratory costs incurred;
  • customised appliances manufactured; and
  • any other reasonable costs incurred before treatment ceased.

Refunds, where applicable, will be assessed after deduction of these costs.

12. Maintenance

The long-term success of dental treatment depends upon appropriate maintenance, regular examinations and patient compliance.

Patients are responsible for maintaining recommended oral hygiene practices and attending ongoing examinations and maintenance appointments.

Specific maintenance requirements applicable to particular procedures are outlined in the relevant Treatment Consent Form.

13. Communications

The Practice may communicate with patients by telephone, SMS, email or other electronic means regarding:

  • appointments;
  • recalls;
  • treatment information;
  • invoices;
  • payment reminders; and
  • follow-up care.

While reasonable precautions are taken, electronic communications cannot be guaranteed to be completely secure.

14. Privacy

The Practice collects, uses, stores and discloses personal information in accordance with applicable privacy legislation and the Practice Privacy Policy.

Where necessary for your treatment, information may be shared with dental laboratories, specialists, medical practitioners and other healthcare providers involved in your care.

Separate consent will always be obtained before identifiable patient information or photographs are used for marketing or promotional purposes.

15. Outstanding Accounts

Accounts unpaid after their due date will be considered overdue.

Where payment remains outstanding, the Practice may:

  • issue reminder notices;
  • suspend future non-urgent treatment;
  • require full payment before future appointments;
  • refer the account to a debt collection agency or legal representatives; and
  • commence legal proceedings where appropriate.

Patients remain responsible for payment of all outstanding treatment fees.

16. Debt Recovery Costs

Where recovery action becomes necessary, the patient agrees to reimburse the Practice for reasonable costs incurred in recovering overdue amounts where permitted by law.

These costs may include:

  • debt collection agency fees;
  • legal costs recoverable under applicable law;
  • court filing fees; and
  • enforcement costs.

 17. Disclosure for Debt Recovery

Where an account remains unpaid, the patient authorises the Practice to disclose personal information reasonably necessary for debt recovery to:

  • debt collection agencies;
  • legal advisers;
  • courts;
  • insolvency practitioners; and
  • other authorised service providers,

to the extent permitted by applicable privacy legislation.

18. Referrals

Where clinically appropriate, the Practice may refer patients to specialists or other healthcare providers.

Those practitioners operate independently and are responsible for the treatment they provide.

Fees charged by other practitioners are separate from those of the Practice.

19. Refusal or Discontinuation of Treatment

The Practice reserves the right to decline or discontinue non-emergency treatment where appropriate, including where:

  • treatment is clinically inappropriate;
  • patient behaviour places staff or other patients at risk;
  • abusive, threatening or inappropriate behaviour occurs;
  • fees remain unpaid;
  • repeated appointments are missed; or
  • the therapeutic relationship has broken down.

Where appropriate, reasonable notice or referral information will be provided.

20. Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.

21. Entire agreement

These Terms and Conditions, together with any applicable Treatment Consent Form and the Practice’s Privacy Policy, constitute the entire agreement between the patient and the Practice regarding the subject matter herein, and supersede all prior discussions, representations or agreements, whether written or oral.

22. Australian Consumer Law

Nothing contained in these Terms and Conditions excludes, restricts or modifies any consumer guarantee or other right that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

23. Limitation of Liability

To the extent permitted by law, the Practice’s liability is limited to the provision of dental services with reasonable care and skill in accordance with applicable professional standards.

Nothing in these Terms limits any rights that cannot lawfully be excluded.

24. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.

Any dispute arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
